Gold Jewellery Products Terms and Conditions
1. General
1.1 These Terms and Conditions apply to transactions in which the
customer purchases Gold Jewellery Products (including pure gold grains and gold
bars) from the Company. Upon ordering or purchasing a product, the customer
shall be deemed to have read, understood and accepted these Terms and
Conditions in full.
1.2 The customer confirms and warrants that products purchased from
the Company are for personal use as the end user, and not for resale to any
third party or for any other commercial purpose.
1.3 The Company's Gold Jewellery Products are sold only to holders
of a valid Premium Gold Membership, including customers who meet the
eligibility requirements for the Premium Gold Membership through a purchase
made at the time of the transaction and apply for it at the same time. Details
shall be subject to the Company's Premium Gold Membership Terms and Conditions.
Gift cards and gift vouchers may not be used to purchase Gold Jewellery
Products.
2. Product Information, Quality and Pricing
2.1 The Company will endeavour to provide information such as
product specifications, images, samples or descriptions, which is for reference
only. The characteristics of the goods actually delivered (including but not
limited to colour, size, weight and texture) may differ from the information
provided, and any difference shall not constitute a defect, misdelivery or
breach of contract.
2.2 The Company guarantees that its pure gold (Chuk Kam) products,
save for parts, have a gold content of not less than 999‰ (i.e. 99.9%). For
manufacturing purposes, the gold parts of pure gold products, such as hinges,
pins, springs and screws, are made of gold of not less than 950 fineness; the
weight of non-gold parts is excluded from the product's gold weight. The final
selling price is calculated on the actual gold weight at delivery, as weighed
by the Company; the accuracy of the weighing device may be subject to a
deviation of ±0.001 tael (approx. ±0.04 gram) due to environmental factors.
2.3 HK JEBN gold prices are
published in store and/or on the Company's website.
3. Product Ordering and Pre-sale
3.1 After the customer selects the design(s), the Company will
issue a Pre-sale Order based on the estimated gold weight of the goods and
collect the full deposit stated therein.
3.2 Once a Pre-sale Order is issued, the customer may not request
cancellation.
3.3 The original Pre-sale Order is the sole proof of deposit
payment and will not be reissued if lost. The Company may handle any such loss
at its discretion on a case-by-case basis and reserves the right of final
decision on whether to deliver the goods. Upon collection, the customer must
present the original Pre-sale Order. The customer may earn or use Premium Gold
Points only upon presentation of a valid member QR code (which must correspond
to the membership number shown on the Pre-sale Order).
3.4 On the collection date, the Company will calculate the final
selling price based on the actual gold weight of the goods and the gold price
shown on the Pre-sale Order, and issue a Sales Invoice. The deposit paid will
be applied towards the purchase price and the customer shall pay the balance;
if the final selling price is lower than the deposit paid, the difference will
be refunded.
3.5 If the HK JEBN gold selling price at the time of collection is
lower than the gold price shown on the Pre-sale Order, the Company will provide
the "Price Assurance Offer" covering the decrease in gold price,
capped at one per cent (1%) of the estimated gold value shown on the Pre-sale
Order. This offer applies only to Gold Jewellery Products (excluding pure gold
grains and gold bars) ordered at the regular price and does not apply to
commission, labour charges, in-stock goods or products already subject to other
promotions. For details, please refer to the in-store posters or the Company's
website.
4. Collection of Goods
4.1 The Company will endeavour to have the goods ready on or before
the estimated collection date, which is for reference only and does not
constitute a guarantee or undertaking.
4.2 Upon arrival of the goods, the Company will notify the customer
by phone at the contact number shown on the Pre-sale Order or through other
channels designated by the Company. The Company shall not be liable if the
customer does not receive the arrival notification in time due to personal
factors such as incorrect or incomplete information provided by the customer,
calls failing to connect, or the blocking of calls from unknown numbers.
4.3 The goods will be reserved for two months from the date the
goods become available for collection (i.e. the date of the arrival
notification). If the goods remain uncollected after that period, the Company
will cancel the transaction and arrange a refund after the customer attends a
store in person, presents the original Pre-sale Order and completes the
relevant procedures. The refund amount shall be the estimated gold weight of
the goods multiplied by the HK JEBN gold buying price on the day following expiry
of the two-month period, capped at the estimated gold value shown on the
Pre-sale Order. Commission, labour charges and other fees are non-refundable,
and an additional handling fee of $500 will be charged for each refund.
5. After-sales Service
5.1 The goods are sold as is at the time of delivery. Once the
Sales Invoice is issued, the customer shall be deemed to have inspected and
accepted the condition, specifications and quality of the goods, and no return
or exchange will be accepted.
5.2 The scope, charges and terms of repair, maintenance and other
after-sales services shall be as set out in store notices or on the Company's
website, and are subject to change from time to time. The customer must present
the original Sales Invoice to receive after-sales services, and the provision
of such services shall be at the Company's discretion having regard to the
condition of the goods.
6. Rights, Disclaimers and Limitation of Liability
6.1 The Company shall not be liable for any inability to perform or
delay in performing its obligations caused by production or logistics delays or
other circumstances beyond its reasonable control (including but not limited to
force majeure events).
6.2 Under no circumstances shall the Company's liability to the
customer exceed the amount paid by the customer for the relevant transaction or
extend to any indirect loss, consequential loss, loss of profit or emotional
distress. Any fees charged by any bank, credit card company or other
third-party service provider in respect of a refund are non-refundable.
6.3 Save as expressly provided herein, and to the maximum extent
permitted by applicable law, the Company disclaims and excludes all express or
implied representations, warranties or conditions relating to the accuracy of
product information and to the products.
6.4 The Company may at any time correct any typographical errors,
pricing errors or other omissions in any materials (including but not limited
to store signage, documents, quotations and promotional materials) without
prior notice or any liability.
6.5 The Company reserves the right to change product information,
specifications and availability at any time, and to refuse, cancel or terminate
any transaction, without prior notice.
7. Miscellaneous
7.1 Product information, prices and offers on the Company's website
and other electronic channels are for reference only. In the event of any
inconsistency, those actually provided in store shall prevail.
7.2 The customer shall fully indemnify the Company against all
losses, costs and expenses (including legal costs) directly or indirectly
arising from: breach of these Terms and Conditions; provision of incomplete,
inaccurate or misleading information; or claims by a third party holding a lost
original Pre-sale Order.
7.3 These Terms and Conditions (including any documents referred to
or incorporated herein) constitute the entire agreement between the customer
and the Company in respect of the relevant transaction, and supersede all prior
oral or written agreements, representations, undertakings or arrangements
between the parties relating thereto.
7.4 If any provision hereof is held by any court or authority of
competent jurisdiction to be invalid, illegal or unenforceable, that provision
shall be deemed ineffective to that extent without affecting the validity,
legality and enforceability of the remaining provisions.
7.5 Amounts stated in these Terms and Conditions shall be
calculated in Hong Kong dollars in Hong Kong and in Macau patacas in Macau.
7.6 The Company reserves the right to amend these Terms and
Conditions from time to time. Any amendment shall take effect upon publication
in store, on the Company's website or through any other channel designated by
the Company. A customer who orders or purchases a product after an amendment
takes effect shall be deemed to have accepted the amendment.
7.7 The Company reserves the right of final decision on
administrative arrangements and procedures concerning these Terms and
Conditions and the relevant transactions. In the event of any dispute, the
Company's interpretation and decision shall be final.
7.8 Save as otherwise required by the mandatory provisions of
applicable law, these Terms and Conditions are governed by and shall be
construed in accordance with the laws of the Hong Kong Special Administrative
Region, and any dispute between the parties arising out of or in connection
with the same shall be subject to the exclusive jurisdiction of the courts of
the Hong Kong Special Administrative Region.
7.9 The Company will collect, use, disclose or transfer the
customer's personal data in accordance with the Privacy Policy Statement on the
Company's website.
7.10 In the event of any discrepancy between the language versions hereof, the Traditional Chinese version shall prevail.
Premium Gold Membership Terms and Conditions
1. General
1.1 These Terms and Conditions apply to the
Company's Premium Gold Membership. A customer who applies for the Premium Gold
Membership shall be deemed to have read, understood and accepted these Terms
and Conditions in full.
1.2 The Company's Gold Jewellery Products
(including pure gold grains and gold bars) are sold only to holders of a valid
Premium Gold Membership, including customers who meet the eligibility
requirements for the Premium Gold Membership through a purchase made at the
time of the transaction and apply for it at the same time. The Premium Gold
Membership is personal to the holder and non-transferable.
2. Premium Gold Membership Eligibility, Term and Membership
Fee
2.1 Only HK JEBN Silver Card, Gold Card or
Platinum Card members may apply for the Premium Gold Membership. A non-member
whose single purchase of food products or other non-Gold Jewellery Products on
the same day meets the HK JEBN member admission requirements published by the
Company, or whose single purchase of Gold Jewellery Products reaches the
following amounts (Silver Card: $5,000; Gold Card: $100,000; Platinum Card:
$1,000,000), may, at the time of purchase, become an HK JEBN member of the
corresponding tier and apply for the Premium Gold Membership, and shall enjoy
Premium Gold Membership offers immediately upon payment of the membership fee.
2.2 The HK JEBN member tier of a member whose
single purchase of Gold Jewellery Products reaches $100,000 or $1,000,000 may
be upgraded to Gold Card or Platinum Card respectively. Amounts spent on Gold
Jewellery Products are not cumulative.
2.3 The Premium Gold Membership has a term of
one year or five years commencing on the date of payment of the membership fee.
Renewal must be made within the 30 days preceding expiry, and the renewed
Premium Gold Membership term shall commence on the day following expiry of the
original term.
2.4 The membership fee (including the renewal
fee) shall be as published by the Company on the date of payment. The
membership fee may not be paid with any points, Premium Gold Points, gift cards
or gift vouchers, and no points or Premium Gold Points will be earned on
payment of the membership fee. Once paid, the membership fee is non-refundable,
unless otherwise provided in a promotion of the Company.
2.5 Only individuals may apply for the Premium
Gold Membership, and supplementary cardholders may not apply with a
supplementary card. Each person may hold only one Premium Gold Membership.
3. Premium Gold Points and Offers
3.1 Premium Gold Membership holders are
entitled to designated offers as published by the Company.
3.2 Where a Premium Gold Membership holder
purchases Gold Jewellery Products from, or sells old gold to, the Company,
Premium Gold Points may be earned on each transaction with a purchase amount
(calculated at the member price after discounts) or buy-back amount of $500 or
above, according to the HK JEBN member tier at the time of issuance of the
Sales Invoice or completion of the sale of old gold; no Premium Gold Points are
earned on issuance of a Pre-sale Order.
3.3 Premium Gold Points generally take effect
on the day following issuance of the Sales Invoice or completion of the sale of
old gold, may be accumulated, and must be used within the validity period,
failing which they shall be forfeited. Premium Gold Points used are deducted
immediately.
3.4 Premium Gold Points are valid for one
year. All accumulated Premium Gold Points are automatically renewed for one
year upon each purchase by the member. Save where the member's HK JEBN member
status lapses or is cancelled or terminated, expiry of the Premium Gold
Membership shall not affect their validity, but upon such expiry, the member
must reapply for the Premium Gold Membership before any accumulated Premium
Gold Points may be used.
3.5 Each Premium Gold Point is equivalent to
$1 and may be used towards the purchase of Gold Jewellery Products, including
the deposit on a Pre-sale Order. Premium Gold Points used in each transaction
shall not in aggregate exceed half of the purchase amount (for a pre-sale
transaction, calculated on the amount stated in the Pre-sale Order), nor exceed
the amount payable, and shall be used in whole numbers.
3.6 Premium Gold Points may not be exchanged
for cash, transferred, or moved to or used together with another member
account.
3.7 A Premium Gold Membership holder must
present a valid member QR code at the time of payment to purchase Gold
Jewellery Products and to earn or use Premium Gold Points. Upon collection
under a pre-sale transaction, the member may earn or use Premium Gold Points
only upon presentation of a valid member QR code corresponding to the
membership number shown on the Pre-sale Order. Screenshots, photographs and
photocopies are not accepted. Premium Gold Points will not be credited
retrospectively. Each transaction may be credited to one member account only.
3.8 Premium Gold Membership holders purchasing
products in the Gold Points or Silver Points categories at the Company's main
stores and/or such signature stores as designated by the Company from time to
time may earn additional Gold Points and/or Silver Points. Purchases in these
categories do not earn Premium Gold Points, and Gold Points and Silver Points
may not be used to purchase Gold Jewellery Products.
3.9 If any transaction is subsequently
cancelled or adjusted, the Company shall be entitled to deduct or cancel
accordingly any Premium Gold Points, additional Gold Points and Silver Points
earned, and the member shall pay any shortfall in cash.
3.10 The calculation and use of Premium Gold
Points shall be as published by the Company.
4. Withdrawal, Expiry and Termination
4.1 If a member withdraws from the Premium
Gold Membership or from HK JEBN membership, or the member's HK JEBN member
status lapses or is cancelled or terminated, the Premium Gold Membership shall
lapse immediately, and all Premium Gold Points and other benefits shall be
forfeited without refund in any form. The same shall apply where the Premium
Gold Membership or the Premium Gold Membership programme is terminated by the
Company.
4.2 A member may reapply for the Premium Gold
Membership only after 180 days have elapsed from the date of the application
for withdrawal from the Premium Gold Membership.
4.3 The Company reserves the right to approve
or reject any Premium Gold Membership application and to suspend or terminate
any Premium Gold Membership or the Premium Gold Membership programme at any
time. The Company shall be entitled to recover from the member any loss arising
from Premium Gold Points or offers obtained by improper means, notwithstanding
any expiry, withdrawal, lapse or termination of the Premium Gold Membership.
4.4 A member holding a valid Premium Gold
Membership when a Pre-sale Order is issued may, under normal circumstances,
collect the goods on the terms of the Pre-sale Order notwithstanding any
subsequent expiry or lapse of the Premium Gold Membership, but shall not earn
or use Premium Gold Points on the transaction.
5. Miscellaneous
5.1 The Premium Gold Membership applies in
both Hong Kong and Macau, subject to the arrangements as published by the
Company.
5.2 Amounts stated in these Terms and
Conditions shall be calculated in Hong Kong dollars in Hong Kong and in Macau
patacas in Macau.
5.3 All information relating to the Premium
Gold Membership, including Premium Gold Points, additional Gold Points and
Silver Points, and the validity periods of the membership and Premium Gold
Points, shall be subject to the Company's records.
5.4 Members shall properly safeguard their
membership cards, member QR codes and accounts, and notify the Company as soon
as practicable of any loss or suspected misappropriation. The Company shall not
be liable for any loss (including loss of Premium Gold Points) arising from any
of the foregoing being lost, misappropriated or used without authorisation.
5.5 The Company reserves the right to amend
these Terms and Conditions from time to time. Any amendment shall take effect
upon publication in store, on the Company's website or through any other
channel designated by the Company. A member who continues to use the Premium
Gold Membership after an amendment takes effect shall be deemed to have
accepted the amendment.
5.6 In the event of any dispute, the Company's
interpretation and decision shall be final.
5.7 If any provision hereof is held by any
court or authority of competent jurisdiction to be invalid, illegal or
unenforceable, that provision shall be deemed ineffective to that extent
without affecting the validity, legality and enforceability of the remaining
provisions.
5.8 Save as otherwise required by the
mandatory provisions of applicable law, these Terms and Conditions are governed
by and shall be construed in accordance with the laws of the Hong Kong Special
Administrative Region, and any dispute between the parties arising out of or in
connection with the same shall be subject to the exclusive jurisdiction of the
courts of the Hong Kong Special Administrative Region.
5.9 The Company will collect, use, disclose or
transfer members' personal data in accordance with the Privacy Policy Statement
on the Company's website.
5.10 In the event of any discrepancy between the
language versions hereof, the Traditional Chinese version shall prevail.
